Consumer Rights – Withdrawal – Cancellation and Return Conditions

GENERAL:

  1. By placing an order electronically through the website you are using, you are deemed to have accepted the pre-information form and the distance sales contract presented to you.

  2. Buyers are subject to the provisions of the Consumer Protection Law No. 6502 and the Distance Contracts Regulation (OG: 27.11.2014/29188) and other applicable laws regarding the sale and delivery of the purchased product.

  3. Buyers will pay the shipping fees, which are the product shipment costs.

  4. Each purchased product shall be delivered to the person and/or organization at the address indicated by the buyer within a maximum of 30 days. If the product is not delivered within this period, the Buyers may terminate the contract.

  5. The purchased product must be delivered fully and in accordance with the qualifications specified in the order and with documents such as a warranty certificate and user manual, if any.

  6. If it becomes impossible to sell the purchased product, the seller must notify the buyer of this situation in writing within 3 days from when they become aware of the situation. The total price must also be returned to the buyer within 14 days.

IF THE PURCHASED PRODUCT PRICE IS NOT PAID:

  1. If the buyer does not pay for the purchased product or cancels the payment in the bank records, the seller's obligation to deliver the product ends.

SHOPPING WITH UNAUTHORIZED USE OF CREDIT CARD:

  1. If it is determined after the product is delivered that the credit card used for the payment was unlawfully used by unauthorized persons, and the product price is not paid to the seller by the related bank or financial institution, the buyer must return the product to the seller within 3 days, with the shipping costs borne by the seller.

IF THE PRODUCT CANNOT BE DELIVERED ON TIME DUE TO UNFORESEEN REASONS:

  1. If there are unforeseen circumstances that the seller cannot foresee and the product cannot be delivered on time, the situation will be communicated to the buyer. The buyer may request the order be canceled, the product replaced with a similar one, or the delivery delayed until the impediment is removed. If the buyer cancels the order, and the payment was made in cash, the payment will be refunded in cash within 14 days from the cancellation. If the buyer made the payment by credit card and cancels the order, the product price will be refunded to the bank within 14 days of the cancellation, but it may take 2-3 weeks for the bank to transfer this amount to the buyer's account.

BUYER'S OBLIGATION TO CHECK THE PRODUCT:

  1. The buyer will inspect the contracted goods/service before taking delivery; they will not accept crushed, broken, torn packaging, etc. damaged and defective goods/services from the cargo company. The accepted goods/services will be deemed to be undamaged and intact. The BUYER must protect the goods/services carefully after delivery. If the right of withdrawal is to be used, the goods/services should not be used. The invoice must be returned with the product.

RIGHT OF WITHDRAWAL:

  1. The BUYER may use the right to withdraw from the contract by rejecting the goods without any legal or criminal liability and without giving any reason, within 14 (fourteen) days from the date of delivery of the purchased product to the person/organization at the indicated address, by notifying the SELLER through the following contact information.

DURATION OF THE RIGHT OF WITHDRAWAL:

  1. If the buyer has purchased a service, this 14-day period starts from the date the contract is signed. The right of withdrawal cannot be exercised for service contracts where the service has begun with the consumer's approval before the end of the withdrawal period. The buyer is informed of the right of withdrawal in Distance Contracts and Cancellation Conditions and places orders knowing these terms.

  2. The costs arising from the use of the right of withdrawal are borne by the SELLER.

  3. To use the right of withdrawal, the SELLER must be notified in writing or through the methods specified by the SELLER within 14 (fourteen) days, and the product must be unused under the "Products for which the Right of Withdrawal Cannot be Exercised" provisions of this contract.

USE OF THE RIGHT OF WITHDRAWAL:

  1. The invoice of the product delivered to the 3rd party or the BUYER (if the invoice of the product to be returned is corporate, it must be sent back with the return invoice issued by the institution when returning it. Order returns billed to institutions cannot be completed unless a RETURN INVOICE is issued.)

  2. The return form, the box of the products to be returned, the packaging, and the standard accessories, if any, must be returned completely and undamaged.

RETURN CONDITIONS:

  1. The SELLER is obliged to return the total price and the documents that put the BUYER in debt to the BUYER within a maximum of 10 days from the receipt of the withdrawal notice and to accept the return of the goods within 20 days.

  2. If there is a decrease in the value of the goods due to the BUYER's fault or if the return becomes impossible, the BUYER is obliged to compensate the SELLER's damages to the extent of their fault. However, the BUYER is not responsible for changes and deteriorations caused by the proper use of the goods/products within the right of withdrawal period.

  3. If the value of the campaign falls below the limit amount due to the exercise of the right of withdrawal, the discount amount used within the campaign will be canceled.

PRODUCTS FOR WHICH THE RIGHT OF WITHDRAWAL CANNOT BE EXERCISED:

  1. Products prepared in line with the BUYER's wishes or explicitly their personal needs and not suitable for return, underwear bottom pieces, swimwear, bikini bottoms, makeup materials, disposable products, goods that are in danger of spoiling quickly or are likely to expire, products that are not suitable for return in terms of health and hygiene if their packaging is opened by the BUYER after delivery, products that are mixed with other products after delivery and cannot be separated due to their nature, periodicals such as newspapers and magazines, other than those provided under a subscription agreement, services performed instantly in an electronic environment or intangible goods delivered instantly to the consumer, and audio or video recordings, books, digital content, software programs, data recording and data storage devices, computer consumables if their packaging has been opened by the BUYER, cannot be returned as per the Regulation. Additionally, the right of withdrawal cannot be exercised for services started with the consumer's approval before the end of the withdrawal period as per the Regulation.

  2. Cosmetics and personal care products, underwear products, swimwear, bikinis, books, reproducible software and programs, DVDs, VCDs, CDs, and cassettes, and stationery consumables (toner, cartridge, ribbon, etc.) must be unopened, untested, intact, and unused for return.

  3. According to the distance contracts regulation; products for which the right of withdrawal cannot be exercised,

Contracts for goods prepared according to the consumer's wishes or personal needs.

Contracts for the delivery of goods that may spoil quickly or expire.

Contracts for goods whose protective elements such as packaging, tape, seal, package have been opened after delivery; and whose return is not suitable in terms of health and hygiene.

Contracts for goods that are mixed with other products after delivery and cannot be separated by their nature.

Contracts for books, digital content, and computer consumables offered in material form if their protective elements such as packaging, tape, seal, package have been opened after delivery.

Contracts for accommodation, transportation of goods, car rental, food and beverage supply, and leisure activities for entertainment or rest to be performed on a specific date or period.

Contracts for services performed instantly in an electronic environment or for intangible goods delivered instantly to the consumer.

DEFAULT AND LEGAL CONSEQUENCES

  1. In case the BUYER defaults on the transactions made by credit card, the cardholder agrees, declares, and undertakes that they will pay interest within the framework of the credit card agreement with the bank and will be liable to the bank. In this case, the relevant bank may resort to legal means; the BUYER may be charged for the costs and attorney fees incurred, and in any case, the BUYER agrees to compensate the SELLER's damages and losses due to the delayed performance of the debt.
